बिरला ओपस स्टाइल महाकुंभ कैंपेन नियम एवं शर्तें
  • ये नियम एवं शर्तें ('टी एंड सी') महाकुंभ ('कुंभ') में जेरी कैन खरीदने वाले उपभोक्ताओं के लिए इस प्रमोशनल ऑफ़र (जिसे आगे 'प्रमोशनल ऑफ़र' या 'ऑफ़र' कहा जाएगा) पर लागू होती हैं, जिसे ग्रासिम इंडस्ट्रीज लिमिटेड (बिरला ओपस पेंट्स डिविजन) (जिसे आगे 'कंपनी' या 'बिरला ओपस पेंट्स' कहा जाएगा) द्वारा प्रायोजित किया गया और आपके लिए लाया गया है। इस ऑफ़र में भागीदारी इन टी एंड सी की संपूर्ण स्वीकृति के अधीन है।
  • प्रमोशनल ऑफ़र तब तक मान्य है जब तक या तो 1,00,000 ग्राहक स्कैन पूरे हो जाएं या 30-04-2025 - जो पहले हो। (इसके बाद "ऑफ़र अवधि" के रूप में संदर्भित) तक, अनुलग्नक में दिए गए बिरला ओपस पेंट्स उत्पादों ('कंपनी उत्पाद') की खरीद पर, ऐसे कंपनी उत्पादों की उपलब्धता के अधीन, वैध है।
  • प्रमोशन केवल भारत के नागरिकों के लिए खुला है। प्रमोशनल ऑफ़र के तहत, पात्र उपभोक्ता या प्रमोशनल ऑफ़र में भाग लेने वाले उपभोक्ता (जिन्हें आगे “प्रतिभागी” कहा जाएगा) नीचे बताए अनुसार डिस्काउंट के हकदार होंगे।

 

1. प्रमोशनल ऑफ़र विवरण:

 

यह प्रमोशनल ऑफ़र प्रतिभागियों को कंपनी के उत्पादों पर ₹ 1000 तक की छूट का हकदार बनाता है, जैसा कि नीचे दिया गया है:

 

  • रु 6000 से रु 11999 तक की खरीदारी पर, रु 250 की छूट पाए।

  • रु 12000 से रु 17999 तक की खरीदारी पर, रु 500 की छूट पाए।

  • रु 18000 से रु 23999 तक की खरीदारी पर, रु 750 की छूट पाए।

  • रु 24000 और उससे ऊपर की खरीदारी पर, रु 1000 की छूट पाए।

2. पात्रता:

 

  • यह ऑफ़र केवल भारत में उन उपभोक्ताओं के लिए वैध है जो महाकुंभ में जेरी कैन खरीदते हैं, जहां प्रमोशनल स्टीकर के साथ बिरला ओपस स्टाइल का विज्ञापन किया जाता है।

  • प्रतिभागी को डिस्काउंट कोड प्राप्त करने के लिए जेरी कैन पर QR कोड को स्कैन करना होगा और व्हाट्सएप पर दी गई प्रक्रिया पूरी करनी होगी।

 

  • बिरला ओपस पेन्ट्स या संबद्ध एजेंसियों के कर्मचारी, डीलर और साझेदार भाग लेने के पात्र नहीं हैं।

  • डिस्काउंट कोड प्रत्येक विशिष्ट मोबाइल नंबर पर केवल एक बार ही वैध होता है।

     

अस्वीकरण - बिरला ओपस इस जेरी कैन का निर्माता नहीं है और इसे कंपनी का उत्पाद नहीं माना जाएगा।

 

3. ऑफ़र अवधि:

 

ऑफ़र का लाभ उठाने के लिए QR कोड को 24.02.2025 से 30.04.2025 के बीच स्कैन किया जा सकता है। QR कोड को स्कैन करके प्राप्त डिस्काउंट कोड की वैधता 31.07.2025 को समाप्त हो जाएगी और इसे उससे पहले रिडीम किया जाना चाहिए।

4. भागीदारी प्रक्रिया:

 

प्रतिभागियों को अपने डिवाइस का उपयोग करके स्टिकर पर QR कोड को स्कैन करना होगा | व्हाट्सएप पर दी गई प्रक्रिया पूरी करनी होगी। पूरा होने पर, व्हाट्सएप के माध्यम से एक अनोखा डिस्काउंट कोड जारी किया जाएगा।

5. रिडेम्प्शन प्रक्रिया:

 

डिस्काउंट कोड को केवल किसी अधिकृत बिरला ओपस पेंट्स डीलर के पास ही रिडीम किया जा सकता है। डिस्काउंट का लाभ उठाने के लिए, प्रतिभागी को खरीद के समय कोड प्रदान करना होगा। प्रत्येक कोड केवल एक ही लेनदेन के लिए मान्य है। रिडेम्प्शन में किसी भी सहायता के लिए, कृपया हमें 18001201234 पर कॉल करें या हमें opuscare@adityabirla.com पर ईमेल करें।

6. सामान्य शर्तें:

 

डिस्काउंट कोड नॉन-ट्रांसफरेबल, नॉन-एक्सचेंजेबल है, और इसे नकद या किसी अन्य प्रकार के क्रेडिट में परिवर्तित नहीं किया जा सकता है। किसी भी परिस्थिति में खोए या चोरी हुए कोड को बदला नहीं जाएगा। इस ऑफ़र को किसी अन्य प्रचार डिस्काउंट या ऑफ़र के साथ नहीं जोड़ा जा सकता है।

7. अयोग्यता:

 

बिरला ओपस पेंट्स किसी भी प्रतिभागी को अयोग्य घोषित करने का अधिकार सुरक्षित रखता है जो शर्तों का उल्लंघन करता हुआ या धोखाधड़ी गतिविधियों में लिप्त पाया जाता है। ऑफ़र का कोई भी दुरुपयोग या दुरुपयोग बिना किसी स्पष्टीकरण के तत्काल अयोग्यता का कारण बनेगा। बिरला ओपस पेंट्स द्वारा उचित समझे जाने पर आगे कानूनी कार्रवाई भी की जा सकती है। कंपनी का निर्णय अंतिम एवं बाध्यकारी होगा।

8. तकनीकी मुद्दे:

 

बिरला ओपस पेंट्स किसी भी नेटवर्क रुकावट, तकनीकी मुद्दों या देरी के लिए जिम्मेदार नहीं है जो डिस्काउंट कोड के रिडेम्प्शन को प्रभावित कर सकते हैं।

9. डेटा गोपनीयता:

 

इस ऑफ़र में भाग लेने से, प्रतिभागी कंपनी के उत्पादों और सेवाओं के संबंध में अभियान-संबंधित संचार और विपणन उद्देश्यों के लिए अपने व्यक्तिगत डेटा के संग्रह और उपयोग के लिए सहमति देते हैं। व्यक्तिगत डेटा के उपयोग को नियंत्रित करने वाले नियम और शर्तें https://www.birlaopus.com/privacy-policy पर उपलब्ध हैं |

10. देयता अस्वीकरण:

 

बिरला ओपस पेंट्स डिस्काउंट कोड के किसी भी अनधिकृत या धोखाधड़ी वाले उपयोग के लिए उत्तरदायी नहीं होगा। कंपनी डिस्काउंट के रिडेम्प्शन को प्रभावित करने वाले बाहरी कारकों के लिए जिम्मेदार नहीं है।

11. ग्राहक सहायता:

 

प्रचार प्रस्ताव से संबंधित प्रश्नों के लिए, प्रतिभागी सोमवार-शुक्रवार (सुबह 10:00 बजे से शाम 6:30 बजे तक) और शनिवार (सुबह 10:00 बजे से दोपहर 2:00 बजे तक) के बीच 18001201234 पर संपर्क कर सकते हैं या कॉल कर सकते हैं, या हमें opuscare@adityabirla.com पर ईमेल कर सकते हैं।

12. संशोधन और समाप्ति:

 

कंपनी बिना सूचना के ऑफ़र को बदलने, रोकने या समाप्त करने का अधिकार रखती है। बिरला ओपस पेंट्स ईश्वरीय कृत्य, सरकारी कार्रवाई, महामारी, स्वास्थ्य आपातकाल, अन्य अप्रत्याशित परिस्थितियों के कारण होने वाले किसी भी नुकसान या क्षति के लिए उत्तरदायी नहीं होगा और ऐसे किसी भी नुकसान के लिए मुआवजे या अन्यथा के रूप में कोई राशि देने के लिए उत्तरदायी नहीं होगा। झूठे, गलत, गुमराह करने वाले या धोखाधड़ी वाले दस्तावेज / सूचना प्रस्तुत करने के परिणामस्वरूप बिरला ओपस पेंट्स द्वारा इस प्रचार से अयोग्यता हो सकती है। परिचालन / चयन प्रक्रिया पर किसी भी प्रश्न / स्पष्टीकरण / सुझाव / संचार आदि पर विचार नहीं किया जाएगा, जो पूर्णतः कंपनी के विवेक पर निर्भर होगा।

13. अन्य:

 

यदि इस ऑफ़र में किसी भी तरह से हस्तक्षेप किया जाता है या बिरला ओपस पेंट्स के उचित नियंत्रण से परे किसी भी कारण से उचित रूप से अपेक्षित रूप से संचालित नहीं किया जा सकता है, जिसमें तकनीकी कठिनाइयाँ, अनधिकृत हस्तक्षेप, धोखाधड़ी, नियामक प्राधिकरणों से निर्देश, अप्रत्याशित घटनाएँ आदि शामिल हैं, लेकिन इन्हीं तक सीमित नहीं हैं, तो कंपनी अपने विवेकाधिकार में, कानून द्वारा अनुमत पूर्ण सीमा तक इस ऑफ़र को रद्द करने, समाप्त करने, संशोधित करने या निलंबित करने का अधिकार सुरक्षित रखती है।

सावधानी: बिरला ओपस पेंट्स के प्रचार व्हाट्सएप चैट या व्हाट्सएप चैट पर दी गई जानकारी को जानबूझकर नुकसान पहुँचाने, ऑफ़र के सामान्य कामकाज में दुर्भावनापूर्ण क्षति या हस्तक्षेप करने या इस ऑफ़र के वैध संचालन को अन्यथा कमजोर करने का कोई भी प्रयास आपराधिक और नागरिक कानूनों का उल्लंघन हो सकता है और यदि ऐसा प्रयास किया जाता है, चाहे वह सफल हो या नहीं, बिरला ओपस पेंट्स कानून द्वारा अनुमत पूर्ण सीमा तक हर्जाना माँगने का अधिकार सुरक्षित रखता है।

यदि बिरला ओपस पेंट्स को किसी भागीदार द्वारा इन शर्तों या किसी अन्य कानूनी दायित्व के उल्लंघन के संबंध में कोई नुकसान होता है या कोई लागत उठानी पड़ती है, तो भागीदार उन नुकसानों, क्षतियों और लागतों के लिए बिरला ओपस पेंट्स को क्षतिपूर्ति करने के लिए सहमत होता है।

प्रमोशनल ऑफ़र से परे दावा न किए गए ऑफ़र, प्रोत्साहन, वाउचर कोड आदि पर बिरला ओपस पेंट्स की कोई कानूनी और वित्तीय देयता नहीं होगी।

बिरला ओपस पेंट्स, इसके ग्राहक, एजेंट और डीलर किसी भी खोए, चोरी हुए या क्षतिग्रस्त वाउचर कोड को प्रतिस्थापित नहीं कर सकते हैं और बिना किसी सूचना के किसी भी विवरण और / या कीमतों को वापस लेने या संशोधित करने का अधिकार सुरक्षित रखते हैं। ऑफ़र अवधि की समाप्ति के बाद पुरस्कारों को रिडीम नहीं जा सकता है और प्रतिभागी ऑफ़र अवधि की समाप्ति की तारीख पर रिडेम्प्शन के अधिकार को छोड़ने के लिए सहमत हैं।

यदि प्रतिभागी ने नेशनल डू नॉट कॉल रजिस्ट्री के साथ पंजीकरण किया है या दूरसंचार प्रदाता के DND के साथ पंजीकरण किया है, तो प्रतिभागी ने विशेष रूप से प्रचार संदेश प्राप्त न करने का अनुरोध किया है। इसलिए, बिरला ओपस पेंट्स प्रतिभागियों को विशिष्ट अभियान के लिए प्रचार संदेश प्राप्त नहीं होने के लिए जिम्मेदार नहीं होगा। इस ऑफ़र में भाग लेने पर, प्रतिभागी बिना किसी अपवाद के, बिना शर्त और अपरिवर्तनीय रूप से इन सभी नियमों और शर्तों को स्वीकार करता है और उनसे बाध्य होने के लिए सहमत होता है।

14. अधिकार क्षेत्र:

 

यह प्रमोशनल ऑफ़र भारत के कानूनों द्वारा शासित है, और विवाद मुंबई की अदालतों के विशेष अधिकार क्षेत्र के अधीन होंगे।

BIRLA OPUS STYLE MAHA KUMBH CAMPAIGN TERMS AND CONDITIONS
  • These terms and conditions (the “T&Cs”) apply to this promotional offer (hereinafter referred to as “Promotional Offer” or “Offer”) for consumers purchasing Jerry cans at Maha Kumbh (“Kumbh”), which is sponsored and brought to you by Grasim Industries Ltd. (Birla Opus Paints Division) (hereinafter referred to as “the Company” or “Birla Opus Paints”). Participation in this Offer is subject to acceptance of these T&Cs in its entirety.
  • The Promotional Offer is valid only in India till the earlier of (i) first 1,00,000 customer scans; or (ii) till 30-04-2025 (last date included) (hereinafter referred to as “Offer Period”) on purchase of Birla Opus Paints Products given in the Annexure (‘Company Products’), subject to the availability of such Company Products.
  • Promotion is open to citizens of India only. Under the Promotional Offer, the eligible consumers or consumers participating in the Promotional Offer (hereinafter referred to as “Participant”) will be entitled for discounts as mentioned below.

 

1. Promotional Offer Details:

This Promotional Offer entitles Participants to a discount of up to ₹1000 on Company Products as given below:

 

  • For purchase value of Rs. 6000 to Rs.11999, discount is Rs. 250.

  • For purchase value of Rs. 12000 to Rs.17999, discount is Rs. 500.

  • For purchase value of Rs. 18000 to Rs. 23999, discount is Rs. 750.

  • For purchase value of Rs. 24000 and above, discount is Rs. 1000.

2. Eligibility:

 

  • The Offer is valid only for consumers in India who purchase jerry cans at Maha Kumbh, where advertisement of Birla Opus style is made along with the promotional sticker.

  • The Participant must scan the QR code on the jerry can and complete the WhatsApp journey to receive the discount code.

  • Employees, dealers, and partners of Birla Opus Paints or associated agencies are not eligible to participate.

  • A discount code is valid only once per unique mobile number

     

    Disclaimer – The jerry cans are not owned or manufactured by Birla Opus Paints and should not be considered as a Company Product.

3. Offer Period:

 

The QR Code to avail the offer can be scanned between 24.02.2025 to 30.04.2025. The discount code received by scanning of the QR code, expires on 31.07.2025 and must be redeemed before that.

4. Participation Process:

 

Participants must scan the QR code on the sticker using their device and complete the WhatsApp journey by entering required details (name, mobile number, and location). Upon completion, a unique discount code will be issued via WhatsApp.

5. Redemption Process:

 

The discount code can only be redeemed with any authorized Birla Opus Paints dealers. To avail the discount, the Participant must provide the code at the time of purchase. Each code is valid for a single transaction only. For any assistance in redemption, please call us on 1800 120 1234 or email us at opuscare@adityabirla.com.

6. General Conditions:

 

The discount code is non-transferable, non-exchangeable, and cannot be converted into cash or any other form of credit. Lost or stolen codes will not be replaced under any circumstances. This Offer cannot be combined with any other promotional discounts or offers.

7. Disqualification:

 

Birla Opus Paints reserves the right to disqualify any Participant found violating the terms or engaging in fraudulent activities. Any misuse or abuse of the Offer will result in immediate disqualification without explanation. It may further attract legal action as deemed fit by Birla Opus Paints. The decision of the Company will be final and binding.

8. Technical Issues:

 

Birla Opus Paints is not responsible for any network interruptions, technical issues, or delays that may affect the redemption of the discount code.

9. Data Privacy:

 

By participating in this Offer, Participants consent to the collection and use of their personal data for campaign-related communication and marketing purposes in relation to Company Products & services. 10. Liability Disclaimer:

 

Birla Opus Paints will not be liable for any unauthorized or fraudulent use of the discount code. The Company is not responsible for external factors affecting redemption of the discount.

12. Amendments and Termination:

 

The Company reserves the right to modify, suspend, or terminate the Promotional Offer at any time without prior notice.

Birla Opus Paints shall not be liable for any loss or damage due to Act of God, Governmental actions, pandemics, epidemics, health emergency, other force majeure circumstances and shall not be liable to pay any amount as compensation or otherwise for any such loss.

The submission of false, incorrect, misleading, or fraudulent documentation/ information may result in disqualification from this promotion by Birla Opus Paints. No queries/ clarifications/ suggestions/ communication etc. shall be entertained on operation/ selection process, which would be entirely in the discretion of the Company.

13. Others:

 

If this Offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Birla Opus Paints, including but not limited to technical difficulties, unauthorized intervention, fraud, directions from regulatory authorities, force majeure events, etc , the Company reserves the right, in its sole discretion, to the fullest extent permitted by law to cancel, terminate, modify or suspend this Offer.

Caution: any attempt to deliberately damage Birla Opus Paints promotional WhatsApp Chat or the information on the WhatsApp Chat, to cause malicious damage or interference with the normal functioning of the Offer, or to otherwise undermine the legitimate operation of this Offer may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, Birla Opus Paints reserves the right to seek damages to the fullest extent permitted by law.

If Birla Opus Paints suffers loss or incurs any costs in connection with any breach of these terms or any other legal obligation by a Participant, the Participant agrees to indemnify Birla Opus Paints for those losses, damages, and costs.

Birla Opus paints will have no legal and financial liability on unclaimed offers, incentives, voucher codes etc. beyond the Promotional Offer.

Birla Opus Paints, its clients, agents, and dealers cannot replace any lost, stolen, or damaged Voucher codes and reserves the right to withdraw or amend any details and/or prices without notice. The rewards cannot be redeemed after the expiry of the Offer Period and the Participant agrees to waive off the right of redemption on the date of expiry of the Offer Period.

If the Participant has registered with the National Do Not Call Registry or has registered with the DND of the telecom provider, then the Participant has specifically requested not to receive promotional messages. Therefore, Birla Opus Paints will not be responsible for Participants not receiving promotional messages for the specific campaign.

By participating in this Offer, the Participant unconditionally and irrevocably accepts and agrees to be bound by all these terms and conditions as stated herein without any exception whatsoever.

14. Jurisdiction:

 

This Promotional Offer is governed by the laws of India, and disputes will be subject to the exclusive jurisdiction of courts in Mumbai.

Product Warranty

Terms and Conditions for product warranty registration of Birla Opus products



  1. The Warranty shall be effective from the date of purchase of the Product as per the tax invoice (“Warranty Start Date”), provided that painting work is fully complete, and the Consumer registers the Product for warranty.

  2. The Product must be registered within 15 days from the date of purchase by calling customer care at 18001201234 or registering on www.birlaopus.com and furnishing purchase details as required during the Warranty registration.

  3. The Warranty shall be valid for parameters and period as defined in the respective product warranty document (‘Warranty Period’) from the Warranty Start Date. 

  4. Upon settlement of any claim, Warranty of replaced Product will not start afresh, and will continue for the remainder of the Warranty Period from the Warranty Start Date.

  5. If there is a break/ lag in completing the painting work, the registration of the Warranty and Warranty Start Date will be determined by the Company at its sole discretion.

  6. The Company may appoint a person to examine and confirm the application of the Product as per the directions specified prior to registering the Warranty.

  7. For registering of Warranty, where quantity of Product purchase is equal to or more than 200 litres, please call our Helpline on 1800 120 1234 with requisite details. The registration of Warranty in such cases is subject to a satisfactory pre‐inspection at site by Company’s representative.

  8. For the warranty to be applicable:
    1. Minimum volume of the product required to be purchased needs to be met
    2. Birla Opus recommended system needs to be used
    3. Product coverage and application guidelines need to be adhered
       

For more details, please refer to respective  product specific warranty document and product information sheet.

  1. Consumer may raise a claim within 30 days of discovering issue(s) noticed on the affected areas based on Warranty Parameters/ scope

  2. The Consumer is required to notify the Company of the issue(s) noticed along with the invoice details, sample pictures and basis for Warranty invocation by contacting the customer care at 1800 120 1234. The Consumer shall provide such additional details as required by the Company and/or allow the Company to visit/inspect the painting site either in portion or entirety at the Company’s discretion.  

  3. In case where the Company decides that the Warranty is applicable on the issue(s) noticed on the affected areas, the Company shall bear the Replacements Costs as detailed in respective product warranty document to repair/ repaint the affected areas.

  4. Replacement Costs shall mean the cost of material and labour required to correct the affected portions, as determined by the Company.

  5. In case where the Company decides that Warranty is not applicable, the same shall be communicated to the Consumer.

  6. Warranty is applicable only to the affected area where the Product is used in accordance with application guidelines and not to the rest of the areas.

  7. In case the Consumer carries out repair works on the areas covered under the Warranty, the same shall be at their own risk and the Company’s Warranty on the Product shall not be valid on such repaired areas.

  8. The Warranty will cover only manufacturing defects of the Product and will not cover any defects arising out of factors not in control of the Company. For more details of exclusions, please refer to the warranty document of respective product. 

  9. Except expressly stated, the Company disclaims any liabilities whether in contract, tort or otherwise. The Company makes no warranty regarding merchantability or fitness of products for any particular purpose. 

  10. The Company shall not be held liable towards loss or damages of incidental, indirect or consequential nature or for any value more than the tax invoice value. 

  11. In case of any disputes, exclusive jurisdiction of the courts of Mumbai shall apply. Governing laws shall be Laws of India.

  12. The facts and all matters concerning any Warranty/ claim/ dispute will always be kept confidential by both the Consumer and the Company.
